Hioki E.E. Corporation (hereinafter the “Company”) provides the following Privacy Policy (hereinafter the “Policy”) for the GENNECT Cloud Service (hereinafter the “Service”) provided on the website concerning the handling of the personal information of users (meaning users of the Service; the same applies hereinafter). This Policy constitutes part of the GENNECT Cloud Terms of Service and the Remote Measurement Service Terms of Service (GENNECT Remote Terms of Service).

Article 1 (Personal Information)
The personal information means the personal information set forth in Article 2 of the Personal Information Protection Law, in other words, information about a living individual that may identify the specific individual from the inclusion of the name, date of birth, other descriptions, or documents, pictures or electromagnetic records (including any information that can be easily collated with other information to identify the specific individual), or information containing an individual identification code.

Article 2 (Method of Collection of Personal Information)
When a user registers for use of the Service, the Company may ask the user to provide the place of employment, name, sex, date of birth, address, telephone number, email address, SNS account, credit card number, and other personal information. The Company may also collect information from records of transactions and payments made between a user and a business partner of the Company, which contains the personal information of the user, from the business partner (e.g., information providers, advertisers, and outlets to which advertisements are distributed).

Article 3 (Purpose of Collecting and Using Personal Information)
The Company collects and uses personal information for the following items:
1. Providing and operating the Service
2. Responding to inquiries from users (including identity verification)
3. Sending information about new features, updates, and campaigns of the Service used by a user, or about other services provided by the Company
4. Contacting a user on an as-needed basis, including providing maintenance or failure information; requesting that the user respond to a questionnaire for improving the Service; or informing the user about an important matter
5. Identifying a user who violates the terms of service or attempts to use the Service for an unlawful or unjust purpose, and refusing use by the user
6. Enabling a user to check, change, or delete registered information, or to check records of using the Service
7. Claiming the payment of usage fees from a user for paid services
8. Analyzing action history on the website for improving or enhancing the Service to provide more useful services customized for that person
9. Other purposes incidental to the above purposes of use

Regarding any Individual-related Information that is collected by using cookies or other tracking technology in services provided by the Company, when it is information required for the Company to use as personal data, the Company shall use it properly in accordance with the Personal Information Protection Law and this Policy.

Article 4 (Items, Collection Method and Usage Purpose of Individual-related Information Collected by App, Excluding Personal Information)
Anonymous information related to the usage condition of features and equipment that is used or connected (hereinafter “Individual-related Information”) shall be collected in the following way and used for the following purposes:
1. Contents of Individual-related Information
Information on the equipment connected with application software and a gateway terminal of the Company, usage condition of the respective features, terminal language settings, country of use, terminal operating system, ID to identify the terminal, and whether related applications of the Company is installed or not will be collected.
2. Collection method
Individual-related Information will be automatically collected by the application software and gateway terminal connected to the Service, as well as the server.
3. Usage purpose
The Company will accumulate Individual-related Information as anonymous statistical information not identifying the individual and use it to improve and enhance the services of the Company.

Article 5 (Change of Usage Purpose)
1. The Company may change the usage purpose set forth in Article 3 (hereinafter the “Usage Purpose”) only if a Usage Purpose after change is reasonably considered to be relevant to the Usage Purpose before such change. 
2. Upon the change of a Usage Purpose, the Company shall notify the user of the Usage Purpose after change or publish it on the website by the method prescribed by the Company.

Article 6 (Cookie Policy)
The website uses cookies to improve services and provide information based on the user’s browsing history. A cookie is a small text file to enable a user to use a website more effectively. It is a function to store the information that a user has visited the site in the Web browser of a PC or smartphone. 
Cookies that are essential for the system to work are always used, regardless of your consent. Other cookies will only be used with your consent.
Cookie information of a user may be used to display content or send e-mail based on the browsing history. It may also collect information about the condition of a user’s use of the site to be jointly used with Google Analytics or other third-party applications for ad serving or data analysis. In this case, the information may be used as personal information as linked with other user information kept by such third party and will be managed under the privacy policy of the third party. 

Article 7 (Third-Party Provision of Personal Information)
1. Without the advance consent of the user, the Company shall not provide personal information to a third party. However, this does not apply where any of the following apply, or it is permitted under the Personal Information Protection Law or other legislation:
-1. When it is necessary for protecting human life, body, or property, and it is difficult to obtain the consent of the person concerned
-2. When it is especially necessary for improving public health or promoting healthy child development, and it is difficult to obtain the consent of the person concerned
-3. When it is necessary to cooperate with a national government organ, local government, or any other person delegated thereby to perform business stipulated in legislation, and obtaining the consent of the person concerned is likely to interfere with the performance of the business
-4. When the following matters are announced or disclosed in advance, and the Company reports them to the Personal Information Protection Commission:
(1) A statement that the Usage Purpose includes provision to third parties
(2) Items of data provided to third parties
(3) Means or method of provision to third parties
(4) A statement that third-party provision of personal information will be discontinued at the request of the person concerned
(5) How to accept the request of the person concerned
2. Notwithstanding the preceding paragraph, the recipient of the information is not a third party in any of the following cases:
-1. When the Company entrusts all or part of the handling of personal information to the extent necessary for the achievement of the Usage Purpose
-2. When personal information is provided incidental to business succession due to a merger or other cause
-3. When personal information is jointly used with specified persons, and the Company notifies the person concerned in advance of such effect, the items of personal information subject to joint use, scope of joint users, Usage Purpose of users, and the name of the person responsible for management of the personal information or provides them in a state where they are easily known to the person concerned

Article 8 (Disclosure of Personal Information)
1. When disclosure of personal information is requested by the person concerned, the Company shall disclose it to that person without delay. However, if disclosing it gives rise to any of the following items, the Company may not disclose all or part of the information, and when it is decided not to disclose it, the Company shall notify the person to such effect without delay:
-1. When it is likely to harm the life, body, property, or other rights and interests of the person concerned or a third party
-2. When it is likely to significantly affect the proper operation of business of the Company
-3. When it violates any legislation
2. Notwithstanding the preceding paragraph, the Company shall not basically disclose such information as history information or characteristic information other than personal information.

Article 9 (Joint Use)
The Company may engage in joint use of personal information of users as specified below:

Article 10 (Security Protection and Security Control Measures)
1. The Company shall take reasonable measures to protect personal information against loss, theft, misuse, falsification, unauthorized access, unauthorized disclosure, and illegal or accidental corruption of personal information. 
2. Should any leakage of personal information or other security incident occur, the Company shall immediately commence emergency measures to prevent its spread and shall notify customers and give reports to the organizations concerned.
3. Other matters concerning security and security control measures shall be specified in the Security and Safety Control Standards sections of the Service Specification.

Article 11 (Correction and Deletion of Personal Information)
1. If a user finds that personal information stored by the Company contains an error, the user may ask the Company to make a correction, addition, or deletion of the personal information (hereinafter “Correction”) through the procedure prescribed by the Company.
2. If the Company finds it necessary to accommodate the request received from the user under the preceding paragraph, the Company shall make the Correction of the personal information without delay.
3. When the Company makes the Correction under the preceding paragraph, or decides not to make Correction, the Company shall notify the user without delay.

Article 12 (Discontinuation of Use of Personal Information)
1. If the Company is requested by the person concerned to discontinue using or erase the personal information (hereinafter “Discontinuation of Use”) on the grounds that the personal information is handled beyond the scope of the Usage Purpose, has been collected by improper means, or for other legal grounds, the Company shall make the necessary investigation without delay.
2. If the Company finds it necessary to accommodate the request based on the results of the investigation under the preceding paragraph, the Company shall make the Discontinuation of Use of the personal information without delay.
3. When the Company makes the Discontinuation of Use under the preceding paragraph, or decides not to make the Discontinuation of Use, the Company shall notify the user without delay.
4. Notwithstanding the preceding two paragraphs, if the Discontinuation of Use requires a substantial amount of expenses, or it is otherwise difficult to make the Discontinuation of Use, and any other measure is available for protecting the rights and interests of the user, the Company shall implement such alternative measure.

Article 13 (Change of Privacy Policy)
1. The contents of this Policy may be subject to a change without giving notice to users, unless otherwise provided for by legislation or this Policy.
2. Unless provided by the Company separately, the Privacy Policy after change shall take effect when it is published on the website.
